Maintenance is a crucial component of matrimonial proceedings and can be claimed by either spouse who lacks adequate financial means for self-support.
Maintenance is generally classified into two categories:
1. Interim Maintenance
Granted during the pendency of the case to ensure that neither party is placed at a financial disadvantage while contesting the matter.
The amount of interim maintenance depends on several factors, primarily:
The financial status of both parties prior to filing the case.
The income or salary of the spouse from whom maintenance is sought.
The objective is to bring both spouses to an equal footing during the legal process.
2. Permanent Maintenance
Awarded upon the final disposal of the case.
May be granted as a monthly/periodic payment or as a lump sum, depending on the unique circumstances of the case.
